Terms of Service

These Terms of Service (the “Terms”) govern your use of the painting services provided by Garners Painting Service (“Garners Painting,” “we,” “us,” or “our”). By engaging our services, you (“you” or “Customer”) agree to be bound by these Terms. Please read them carefully.

1. Services Provided

Garners Painting Service offers residential and commercial painting services, which may include but are not limited to:

Interior painting
Exterior painting
Cabinet painting
Deck and fence staining/painting
Surface preparation (e.g., cleaning, scraping, sanding, priming)
Minor repairs related to painting

The specific services to be provided will be outlined in a separate written estimate or proposal (the “Estimate”) provided to you by Garners Painting.

2. Estimates and Contracts

All Estimates are valid for a period of [Number] days from the date issued, unless otherwise specified.
The Estimate will detail the scope of work, materials to be used (if specified), and the estimated cost of the services.
A binding contract is formed when you accept the Estimate in writing (including email confirmation) and provide any required deposit.
Any changes or additions to the scope of work after the contract is formed may result in additional charges and require a written change order signed by both parties.

3. Customer Responsibilities

As the Customer, you are responsible for:

Providing accurate information regarding the project, including the surfaces to be painted, their condition, and any specific requirements or concerns.
Ensuring that the work area is accessible and free from obstructions, including furniture, decorations, and personal belongings, unless otherwise agreed upon in the Estimate.
Securing any pets or children to ensure their safety and prevent interference with the work.
Providing access to necessary utilities, such as water and electricity, if required for the completion of the services.
Notifying Garners Painting of any known hazards, such as lead paint or asbestos, prior to the commencement of work. Additional charges may apply for handling such materials in accordance with applicable regulations.
Making timely payments as outlined in the Estimate.

4. Payment Terms

The payment schedule will be specified in the Estimate. Typically, a deposit may be required upon acceptance of the Estimate, with the remaining balance due upon satisfactory completion of the work.
Payments can be made via [List accepted payment methods, e.g., cash, check, credit card].
Overdue payments may be subject to a late payment fee of [Percentage]% per month or the maximum rate allowed by law.
You are responsible for any taxes applicable to the services provided.

5. Scheduling and Delays

Garners Painting will make reasonable efforts to adhere to the agreed-upon schedule. However, unforeseen circumstances such as weather conditions, material availability, or other delays beyond our control may affect the project timeline.
We will communicate any significant delays to you as soon as reasonably possible.
Garners Painting is not liable for any losses or damages resulting from delays outside of our direct control.

6. Materials

Unless otherwise specified in the Estimate, Garners Painting will supply all necessary paints, materials, and equipment required for the completion of the project.
If you choose to supply your own materials, they must be of suitable quality and quantity as specified by Garners Painting. We are not responsible for the application or performance of customer-supplied materials.

7. Warranty

Garners Painting warrants that the painting services will be performed in a professional and workmanlike manner, consistent with industry standards.
Our warranty covers defects in workmanship for a period of [Number] [Months/Years] from the date of completion. This warranty typically covers issues such as peeling, blistering, or flaking paint that is directly attributable to faulty workmanship.
This warranty does not cover:

- Damage caused by normal wear and tear, abuse, misuse, or accidents.
- Damage resulting from structural defects, moisture issues, or other pre-existing conditions.
- Fading or discoloration due to sunlight or other environmental factors.
- Minor imperfections that are not visually significant.
- Customer-supplied materials.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Garners Painting Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, lost profits, data loss, or business interruption) arising out of or in connection with the services provided, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or the services provided shall not exceed the total amount paid by you to Garners Painting under the applicable contract.

9. Indemnification

You agree to indemnify, defend, and hold harmless Garners Painting Service, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms; (b) your negligence or willful misconduct; or (c) any damage to property or injury to persons caused by you or your agents.

10. Termination

Either party may terminate the contract upon written notice if the other party materially breaches these Terms and fails to cure such breach within [Number] days after receiving written notice of the breach.
Garners Painting may terminate the contract immediately if you fail to make timely payments.
Upon termination, you will be responsible for paying for all services performed and materials supplied up to the date of termination.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the services provided shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You hereby consent to the jurisdiction of such courts.

12. Entire Agreement

These Terms, together with the applicable Estimate and any written change orders, constitute the entire agreement between you and Garners Painting Service with respect to the services provided and supersede all prior or contemporaneous communications and proposals, whether oral or written.

13. Amendments

Garners Painting Service reserves the right to modify these Terms at any time. Any changes will be posted on our website or provided to you in writing. Your continued engagement of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
